2. Types of Information Collected and Uses of Collected Information
We collect two types of information about our Website Users: Personally Identifiable User Information and Non-Personally User Identifiable Information.
Personally Identifiable User Information
Personally Identifiable User Information is information that identifies a specific User. When you engage in certain activities on the Website, such as creating an account, ordering a service from us, filling out a survey, sending us feedback, requesting information about our services, (collectively, “Personal Identification Activities”), we may ask you to provide certain information about yourself. It is optional for you to engage in a Personal Identification Activity. If you elect to engage in a Personal Identification Activity, however, we may ask you to provide us with certain personal information about yourself, such as your first name, last name, mailing address (including zip code), email address, and/or telephone number. When you order services, we may also ask you to provide us with your credit card number, expiration date and authentication codes or related information. Depending on the activity, some of the information we ask you to provide is identified as mandatory and some is identified as voluntary. If you do not provide the mandatory information for a particular activity that requires it, you will not be permitted to engage in that activity.
Non-Personally User Identifiable Information
We use Non-Personally Identifiable User Information to troubleshoot, administer the Website, analyze trends, gather demographic information, comply with applicable law, and cooperate with law enforcement activities. We may also share this information with our authorized Third Party Service Providers to measure the overall effectiveness of our online advertising, content, and programming.

We will not share, sell, rent, or trade your Personally Identifiable User Information with other parties except as provided below:
We will share Personally Identifiable User Information on your behalf only to send reminders that you have requested.
We may share your Personally Identifiable User Information with authorized Third Party Service Providers who perform functions on our behalf, like sending out and distributing emails and/or SMSs. We may share your Personally Identifiable User Information with such Service Providers to provide our services, send email, remove repetitive information on User and/or clients lists, analyze data, provide marketing assistance, provide search results and links, process credit card payments operate the Website, troubleshoot, and provide customer service. We may also share your Personally Identifiable User Information with Service Providers to accomplish our administrative tasks. We encourage you and Third Party Service Providers to adopt and post privacy policies. However, the use of your Personally Identifiable User Information by such parties is governed by the privacy policies of such parties and is not subject to our control.

We may disclose or share Non-Personally Identifiable User Information with advertisers and our affiliated companies.
We also use Third Party Service Providers to track and analyze Non-Personally Identifiable User Information usage and volume statistical information from our Users to administer our Website and constantly improve its quality. We may also publish this information for promotional purposes. Please note that this is not Personally Identifiable User Information, only general summaries of the activities of our Users. Such data is collected on our behalf, and is owned and used by us.

We believe that you should have the ability to access and edit the Personally Identifiable User Information you provide us. Please indicate your first name, last name, address (including zip code), telephone and/or email address, and what information you would like to update when you contact us.
We encourage you to promptly update your Personally Identifiable User Information if it changes. You may ask to have the information on your account deleted or removed; however, because we may keep track of past transactions, you cannot delete information associated with past transactions on the Website. In addition, it may be impossible for us to completely delete all of your information because we periodically backup information.
6. User Choices on Collection and Use of Information
As discussed above, you can always choose not to provide information, although it may be required to engage in a certain activity on the Website.
As a condition to using our services, we may send you Administrative and Promotional emails and/or SMSs We may send you information regarding your account activity and purchases as well as updates about our products and promotional offers. You cannot opt-out of Administrative Emails. “Administrative Emails” relate to a User’s activity on the Website, and include emails regarding a particular User’s account, requests or inquiries, and purchases of services. In contrast to Administrative Emails, however, you do have a choice with respect to Promotional Emails. Promotional Emails advertise our services, including exclusive sales and other offers, and/or the services of our affiliated companies. If you do not want to receive Promotional Emails from us, you may elect to opt-out of receiving Promotional Emails at any time after registering by e-mailing us at email@example.com, by writing to us at the address contained herein, or by hitting the “unsubscribe” button at the bottom of any of our Promotional Emails. When contacting us, please indicate your first name, last name, address (including zip code), telephone and/or email address, and what Promotional Emails you do not want to receive.

We take security seriously and take numerous precautions to protect the security of Personally Identifiable User Information. You can access your Personally Identifiable User Information on our Website through a password and your email address. This password is encrypted. We recommend that you do not share your password with anyone. In addition, your Personally Identifiable User Information resides on a secure server that only selected personnel have access to. We encrypt certain sensitive information using Secure Socket Layer (SSL) technology to ensure that your Personally Identifiable User Information is safe as it is transmitted to us.
Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we employ commercially reasonable security measures to protect data and seek to partner with companies which do the same, we cannot guarantee the security of any information transmitted to or from the Website, and are not responsible for the actions of any third parties that may receive any such information.

We may use other industry standard technologies like pixel tags and web beacons to track your use of our Website pages and promotions, or we may allow our Third Party Service Providers to use these devices on our behalf. Pixel tags and web beacons are tiny graphic images placed on certain pages on our Website, or in our emails that allow us to determine whether you have performed a specific action. When you access these pages or open or click an email, pixel tags and web beacons generate a Non-Personally Identifiable notice of that action. Pixel tags allow us to measure and improve our understanding of User traffic and behavior on our Website, as well as give us a way to measure our promotions and performance.

Minors under the age of 18 may not use the Website. We do not knowingly collect personal information from anyone under the age of 18, and no part of the Website is designed to attract anyone under the age of 18. Pijons does not offer services for purchase by children.
Notice of Privacy Rights to California Residents
California law requires that we provide you with a summary of your privacy rights under the California Online Privacy Protection Act (the “Act”) and the California Business and Professions Code. As required by the Act, we will provide you with the categories of Personally Identifiable User Information that we collect through the Website and the categories of third party persons or entities with whom such Personally Identifiable User Information may be shared for direct marketing purposes at your request. California law requires us to inform you, at your request, (1) the categories of Personally Identifiable User Information we collect and what third parties we share that information with; (2) the names and addresses of those third parties; and (3) examples of the products marketed by those companies. The Act further requires us to allow you to control who you do not want us to share that information with. To obtain this information, please send a request by email or standard mail to the address found below. When contacting us, please indicate your first and last name, address (including zip code), telephone and/or email address, and what Personally Identifiable User Information you do not want us to share with Partners and/or Affiliates. 2. Company Account
As a User of Pijons’s services, you will create a Company account on the Website. To this end, you will be asked a variety of questions about the Company, including but not limited to, the type of business, your first name, last name, mailing address (including zip code), telephone number, and/or the name or number of employees. In order to use the Service, Pijons may require verification of the company’s valid physical addresses and/or phone number.
You will also be asked to provide a user name and password. You are entirely responsible for maintaining the confidentiality of your password. You may not use the account, username, or password of someone else at any time. You agree to notify Pijons immediately on any unauthorized use of your account, user name, or password. Pijons shall not be liable for any loss that you incur as a result of someone else using your password, either with or without your knowledge. You may be held liable for any losses incurred by Pijons, its affiliates, officers, directors, employees, consultants, agents, and representatives due to someone else’s use of your account or password.
3. Levels of Service
Pijons has three levels of service as follows: (a) the Carrier Pijons level of service provides up to 20 reminders per month free of charge; (b) the Racing Pijons level of service provides up to 100 reminders per month for a monthly service fee; and (c) the Flock of Pijons level of service provides unlimited reminders per month for a higher monthly service charge. Each level of service may be canceled or upgraded at any time upon written notice to Pijons.
4. Free trial
Pijons offers a free 30-day trial period for the Racing Pijons and Flock of Pijons level of service as well as for the VIP add-on service.
If you are on the 30-day trial period, you may cancel your account with written notice at any time prior to the end of the trial period. If you not cancel or downgrade your account before 30 days, the payment collected on sign-up will be automatically charged and your level of service will continue on a monthly subscription basis as provided below.
5. Monthly Subscription
Each level of service is on a monthly subscription plan and will automatically renew unless canceled, downgraded or upgraded. In the event that Pijons does not receive full payment for the Racing Pijons or Flock of Pijons levels of service within three days of the date payment is due, all services will be downgraded to the Carrier Pijons level of service until payment in full is received by Pijons. The Racing Pijons and Flock of Pijons service fee will not be prorated if terminated early. If the level of service is upgraded or downgraded, the change will be effective on the first day of the month after notice of the change is received by Pijons.
6. User Content
You grant Pijons a license to use the materials you post to the Site or Service. By posting, downloading, displaying, performing, transmitting, or otherwise distributing information or other content ("User Content") to the Site or Service, you are granting Pijons, its affiliates, officers, directors, employees, consultants, agents, and representatives a license to use User Content in connection with the operation of the Internet business of Pijons and its affiliates, including without limitation, a right to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, and reformat User Content. You will not be compensated for any User Content. You agree that Pijons may publish or otherwise disclose your name in connection with your User Content. By posting User Content on the Site or Service, you warrant and represent that you own the rights to the User Content or are otherwise authorized to post, distribute, display, perform, transmit, or otherwise distribute User Content.
You understand and agree that Pijons serves as your authorized agent solely for the purpose of sending reminders, and/or information to other people on your behalf; and that Pijons does not act as an insurer or as your contracting agent. Pijons is not responsible for the failure of your customer or client to attend your appointment, meeting or for the payment of any fee to you. Pijons is not responsible for your failure to honor an appointment, meeting or for the services you provide to your customer or client.
7. Compliance with Intellectual Property Laws
When accessing the Site or using the Service, you agree to obey the law and to respect the intellectual property rights of others. Your use of the Service and the Site is at all times governed by and subject to laws regarding copyright ownership and use of intellectual property. You agree not to upload, download, display, perform, transmit, or otherwise distribute any information or content (collectively, "Content") in violation of any third party’s copyrights, trademarks, or other intellectual property or proprietary rights. You agree to abide by laws regarding copyright ownership and use of intellectual property, and you shall be solely responsible for any violations of any relevant laws and for any infringements of third party rights caused by any Content you provide or transmit, or that is provided or transmitted using your User ID. The burden of proving that any Content does not violate any laws or third party rights rests solely with you.

Pijons has in place certain legally mandated procedures regarding allegations of copyright infringement occurring on the Site or with the Service. Pijons has adopted a policy that provides for the immediate suspension and/or termination of any Site or Service user who is found to have infringed on the rights of Pijons or of a third party, or otherwise violated any intellectual property laws or regulations. Pijons’s policy is to investigate any allegations of copyright infringement brought to its attention. If you have evidence, know, or have a good faith belief that your rights or the rights of a third party have been violated and you want Pijons to delete, edit, or disable the material in question, you must provide Pijons with all of the following information: (a) a physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed; (b) identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works; (c) identification of the material that is claimed to be infringed or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Pijons to locate the material; (d) information reasonably sufficient to permit Pijons to contact you, such as an address, telephone number, and if available, an electronic mail address at which you may be contacted; (e) a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (f) a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. PIJONS HEREBY DISCLAIMS ALL WARRANTIES. PIJONS IS MAKING THE SITE AVAILABLE "AS IS" WITHOUT WARRANTY OF ANY KIND. YOU ASSUME THE RISK OF ANY AND ALL DAMAGE OR LOSS FROM USE OF, OR INABILITY TO USE, THE SITE OR THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIJONS EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. PIJONS DOES NOT WARRANT THAT THE SITE OR THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SITE OR THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

PIJONS’S LIABILITY TO YOU IS LIMITED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PIJONS BE LIABLE FOR DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, OR LOST DATA, REGARDLESS OF THE FORESEEABILITY OF THOSE DAMAGES) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR ANY OTHER MATERIALS OR SERVICES PROVIDED TO YOU BY PIJONS. This limitation shall apply regardless of whether the damages arise out of breach of contract, tort, or any other legal theory or form of action.

Pijons imposes certain restrictions on your permissible use of the Site and the Service. You are prohibited from violating or attempting to violate any security features of the Site or Service, including, without limitation, (a) accessing content or data not intended for you, or logging onto a server or account that you are not authorized to access; (b) attempting to probe, scan, or test the vulnerability of the Service, the Site, or any associated system or network, or to breach security or authentication measures without proper authorization; (c) interfering or attempting to interfere with service to any user, host, or network, including, without limitation, by means of submitting a virus to the Site or Service, overloading, "flooding," "spamming," "mail bombing," or "crashing;" (d) forging any TCP/IP packet header or any part of the header information in any e-mail or in any posting using the Service; or (e) attempting to modify, reverse-engineer, decompile, disassemble, or otherwise reduce or attempt to reduce to a human-perceivable form any of the source code used by Pijons in providing the Site or Service.
